Article Two:

これを読んで「イスラームの原則」と「民主主義の原則」の原則が衝突する場合はどちらが優先されるんだろう？と思わない人は少ないと思います。やはり先に書いてあるほうが優先されるのでしょうか。あるいはそもそもその二つの原則が衝突するという思考はしない方がいいのでしょうか。
そのほか注目されていた条項は
2. The Supreme Federal Court consists of a number of judges and Sharia (religious law) and law experts. Their number and the process of choosing them are organized by a law approved by two-thirds of the parliament council.
となっています。やはりイスラーム法の専門家も最高裁にいれるのですね。
石油については原則的には
Article 109
Oil and gas are owned by Iraqi people in all states and provinces.
ということになっていますが、
A share [of oil] should be given to the oppressed states, which were deprived of it by the former regime, by which a balanced development to different areas in the country is guaranteed. This should be organized by a law.
という条項も入れられています。ここの "the oppressed states, which were deprived of it by the former regime" というのはクルド人の住む地域なのでしょうか、やはり。
しかしこの憲法で一番注目すべきは、両性の平等を明記した箇所がないことではないでしょうか。たまたまここから抜け落ちているのかもしれませんが、もしそうでないとしたら残念なことだと思います。
